Intent to Become a Charter Township

Resolution of Intent to Become a Charter Township

TOWNSHIP ___________________

_____________________ COUNTY, MICHIGAN

WHEREAS, the Township Clerk has been notified by the Secretary of State of the State of Michigan that _______________ Township has a population of 2,000 or more inhabitants, excluding the population of any incorporated village, notice of which notification was duly published in the as required by law, and

WHEREAS, under the provisions of 1976 PA 90, the Township is accordingly eligible to be incorporated as a charter township by resolution of the Township Board of its intent to so incorporate and a subsequent resolution of said Township Board at least 60 days after the adoption of the first resolution to be incorporate, and

WHEREAS, if no petition for referendum on the question of such incorporation is received by the Township Clerk signed by not less than 10 percent of the number of electors of the township voting for Township Supervisor at the last election, said township shall be incorporated as a charter township on the date of said second resolution.

NOW, THEREFORE, in consideration of the foregoing, IT IS HEREBY RESOLVED that the _________ Township Board does hereby declare its intent, by resolution to be adopted not less than 60 days from the date hereof, to incorporate _______________ Township as a charter township unless the aforesaid petition of this agreement to so incorporate is filed with the Township Clerk prior to the passage of such final resolution.

ELECTION RESOLUTION TO BECOME CHARTER TOWNSHIP

________________ TOWNSHIP
________________ COUNTY, MICHIGAN

WHEREAS, the township has been advised by the Secretary of State that it has attained a population in excess of 2,000 and is eligible to become a charter township,

AND WHEREAS, in accordance with law and statute provided, a proper notice of the foregoing, together with the options available to the township board and electorate in this connection was published in a newspaper of general circulation within the township within the 15-day and seven-day periods prescribed therefor,

AND WHEREAS, not less than 60 days have expired since the date of aforesaid publication and township board resolution pertinent thereto,

AND WHEREAS, the township board of said township desires to submit the proposition of becoming a charter township on the ballot at the next __________ election within the township to be held on ____________ , 20___ .

NOW THEREFORE, BE IT HEREBY RESOLVED by the township board as follows:

(Where special election is desired)
That a special election within the township be held on ______________ , 20___ from 7:00 a.m. until 8:00 p.m. of said day provided that same is approved by the County Election Scheduling Committee for the purpose of voting upon the following proposition:

"Shall the Township of ___________ incorporate as a charter township under the provisions of Public Act 359 of 1947, as amended, which shall constitute the charter of such charter township?

1. That such special election be conducted in accordance with the Michigan Election Law pertinent thereto.

(Where a regular election is desired)
1. That the following proposition be submitted to the qualified registered electors of the township at the next regular election within the township scheduled for ____________ , 20___ :

"Shall the Township of ______________ incorporate as a charter township under the provisions of Public Act 359 of 1947, as amended, which shall constitute the charter of such charter township?

2. All election notices pertaining to said regular election shall include notice of the right to vote on the foregoing proposition at such regular meeting.

3. All resolutions or parts of resolutions in conflict with the within resolution are hereby repealed.
